Privacy Statement

Ostrica considers the personal privacy of its relations very important. Our service is all about data; your personal data. Protecting it and controlling it is essential to us. We are happy to answer your questions about how your data is used.

In this Privacy Statement you will find such answers in short. For further questions or comments, you can always contact our Privacy Officer (contact details below).

The data we refer to is mainly provided by yourself, but we also process personal data received from other parties, for example from Social Media, Google or the Chamber of Commerce, for due diligence or marketing purposes.

Your data will only be used to give the best possible execution to our services as required by law, or because of legitimate interests. The data will no longer be preserved than is necessary for the purpose of its use.

We do not share your information with others unless it concerns

  • Supervisors or governments, such as the tax authorities, when this is legally required

  • Our contractors, when this is necessary for the execution of the agreement we have with you or the protection of legitimate interests.

In such cases, clear agreements will always exist with such third parties about our responsibility for your data. In the context of investment services, also outside of Europe, we are legally obliged under MiFID II or anti-money laundering rules to share transaction details, including your account number and BSN number with (tax) supervisors, also outside of Europe.

When your data could be shared outside of Europe in this way, we will do so only based on the agreements made by the European legislator or based on your explicit consent, for example when reclaiming withholding tax.

In certain situations we also process so called 'sensitive data' (GDPR Legislation). Such data is called sensitive because this data can say something about your personal privacy in particular.

Our experience shows that clients sometimes entrust us with sensitive personal data about e.g. health or certain preferences. They, just like we do, find that relevant to determine the suitability of our services and products. If you entrust us with such sensitive data, we assume your consent, which is required by law.

In that case, we agree that you inform us if you wish to revoke your consent. As long as we are able, in spite of your withholding permission, to continue to determine the suitability and appropriateness of our services, we will answer to your request to delete sensitive data and the provided services will possibly be carried on unaltered.

However, it may also mean that we believe that without such information we will have to cease all or part of the service, as in such a case we can no longer meet our duty of care

You can always request us to inspect, correct, transfer, limit the use or removal of your personal data or object to the use thereof.
